Welcome to Ask Ainstein ("Platform"). By accessing or using our website, mobile application, or teacher/student dashboards, you agree to these Terms of Service ("Terms"). If you do not agree, please discontinue use of the Platform.

1. Acceptance of Terms

By creating an account or using any part of the Platform, you agree to these Terms, the Privacy Policy, and all guidelines or policies communicated by us. If you are using Ask Ainstein on behalf of an institution, you confirm that you have the authority to do so.

2. Eligibility

  • The Platform is intended for students, teachers, parents, and educational institutions.
  • Users under 13 must use the Platform under parental consent or under a school program with appropriate authorization.
  • Schools are responsible for ensuring compliance with applicable child safety laws.

3. Account Creation & Responsibilities

  • Information Accuracy: You must provide accurate information during registration.
  • Security: You are responsible for maintaining confidentiality of your login credentials.
  • Usage Restrictions: You agree to use the Platform solely for lawful, educational purposes.
  • Email Communication: You consent to receive essential service-related emails, transactional notifications, and verification emails.

4. User Roles

The Platform supports multiple user types, each with defined permissions:

  • Student
  • Teacher
  • Parent/Guardian
  • School Administrator
  • Internal CMS Admin (restricted to authorized Company staff)

Unauthorized access to another role or privilege is strictly prohibited.

5. AI Features & Generated Content

The Platform includes advanced AI features such as:

  • AI-generated explanations, steps, diagrams, and images
  • AI-based question creation and modification
  • AI tutoring and chat interactions (text + audio)
  • Adaptive difficulty recommendations
  • Automated mind maps, FAQs, and summaries

AI Accuracy Disclaimer

AI outputs may contain errors or inaccuracies. They should be reviewed by teachers, parents, or institutions before relying on them.

AI Safety

You must not attempt to manipulate the AI into producing:

  • Harmful, abusive, or unsafe content
  • Sensitive or inappropriate content
  • Content intended to deceive or exploit others

We may restrict or suspend accounts misusing AI tools.

User Responsibility

Teachers and schools must supervise student interaction with AI features and ensure age-appropriate usage.

6. User-Generated Content & Public Sharing

Teachers and institutions may upload or create:

  • Assessments
  • Notes
  • Images
  • Worksheets
  • Image-labeling tasks
  • Curriculum materials
  • Video embeds
  • Publicly shared assessments

Ownership

You retain ownership of the content you create or upload.

License to Us

By uploading or generating content on the Platform, you grant us a non-exclusive, worldwide, royalty-free license to store, process, display, modify (via AI tools), and distribute the content solely to operate and improve Platform features.

Public Assessments

If you choose to publish assessments publicly:

  • Other users may view and use the material
  • You confirm you have rights to all uploaded content
  • You accept that removal requests must be legitimate and reviewable

We may remove any content that violates law, safety, IP rights, or our policies.

Prohibited Content

Users may not upload:

  • Copyrighted material they do not own
  • Abusive, explicit, or inappropriate content
  • Malware, harmful code, or misleading resources
  • Images of minors without proper school/guardian authorization

7. Protection of Minors & Educational Data

Ask Ainstein is used by minors under school or parental supervision.

We commit that:

  • We collect only educationally relevant data
  • We do not sell, trade, or monetize student/child data
  • Parents and schools may request deletion of student data
  • Student data is used solely for improving learning experiences
  • Schools are responsible for ensuring parental consent where required

8. Acceptable Use of AI & Platform

You agree not to:

  • Attempt to bypass security or misuse features
  • Reverse engineer any part of the Platform
  • Harass or bully students, teachers, or others
  • Publish inappropriate or harmful content
  • Manipulate gamification elements (XP, streaks, leaderboards)
  • Use AI for cheating, harmful prompts, or generating unsafe output

We may suspend, restrict, or permanently terminate accounts violating these rules.

9. No Professional Advice

AI and human-provided content on Ask Ainstein is educational only, not professional advice.

The Platform does not offer:

  • Medical advice
  • Psychological advice
  • Legal or financial advice
  • Safety-critical recommendations

Any such use is prohibited.

10. Gamification Features

The Platform includes:

  • XP
  • Badges
  • Leaderboards
  • Streaks
  • Teacher reward programs (where applicable)

These features:

  • Have no monetary value (unless explicitly stated)
  • Are for motivation and engagement only
  • May be modified or removed at any time

We are not responsible for disputes arising from gamification outcomes.

11. School and Institution Responsibilities

Schools using Ask Ainstein agree to:

  • Obtain necessary parental or guardian consent
  • Supervise teacher and student interactions
  • Ensure compliance with child protection laws
  • Manage teacher accounts responsibly
  • Remove unauthorized or unsafe content created within their institution
  • Ensure all uploads comply with copyright and privacy laws

Schools are fully responsible for their users' conduct on the Platform.

12. Uploads, Storage & Media

Users may upload documents, worksheets, diagrams, lesson notes, and images.

We reserve the right to:

  • Compress, optimize, or process uploaded files
  • Remove unsafe or prohibited content
  • Limit storage based on plan or fair use

13. Voice & Audio Interactions

The "Talk Mode" feature produces AI-generated audio based on your text input.

Important:

  • We do not record or store user voice (only text inputs)
  • Audio may not perfectly match the text
  • It must not be used for sensitive decision-making

14. Payments, Plans & Subscriptions

(If applicable)

  • Prices and fees will be displayed within the Platform
  • Plans may renew automatically unless cancelled
  • Refunds follow the policy shown at time of purchase
  • Schools must manage licenses and payments for their accounts

15. Third-Party Services

We use services such as:

  • Google SSO, Microsoft OAuth
  • AWS, Cloudflare, MongoDB
  • Email/SMS providers (SendGrid, Twilio)
  • AI model providers

Use of these services is governed by their respective terms and privacy policies.

16. Disclaimers

  • The Platform is provided "as is"
  • We do not guarantee exam results or academic performance
  • AI may generate inaccurate or incomplete responses
  • We do not guarantee uninterrupted availability

17. Limitation of Liability

To the maximum extent permitted by law, Axel Education Labs Pvt Ltd is not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data or content
  • Errors in AI-generated output
  • Misuse of content by teachers, students, parents, or institutions
  • Any uploaded content
  • Downtime, bugs, or technical issues

Your sole remedy is to discontinue use of the Platform.

18. Termination

We may suspend or terminate accounts that:

  • Violate the Terms
  • Pose safety or legal risks
  • Upload harmful or prohibited content
  • Misuse AI or attempt unauthorized access

Users may terminate accounts by emailing support.

19. Changes to These Terms

We may update these Terms as our Platform evolves or as required by law. Significant updates will be communicated via email or in-app notifications. Continued use indicates acceptance of the updated Terms.

20. Governing Law & Dispute Resolution

These Terms shall be governed and interpreted in accordance with the laws of India.

Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996.

The seat and venue of arbitration shall be Hyderabad, India, unless mutually agreed otherwise.
